This is a link provided by my sister. As a small business owner, this sort of government policy terrifies me. "Smart regulation," according to our government, is regulation that allows the regulatory agency to decide which companies go out of business, and which are protected! This is an economic model that has been tried before, by Mussolini - private ownership but government guidance of the economy. But even without the whiff of Fascism, it is still a terrible idea. Incumbents do not innovate as aggressively as entrants - both economic theory and (more important) economic research show this to be the case. Yes, new entrants face significant hurdles, but the government does not help by making it more difficult for the small firms to innovate.
And I won't even go into how I feel about making it illegal for individuals to control access to their own health information.
